well its not totally true that you must first have the systems on your variance
on my variance i have it worded so that i can use any certified laser system the only models listed are the ones my company manufactures

below is part d from my variance

    D. Product for Which Variance is Granted
This variance is granted for the Class IIIb and IV laser light
shows based on Party Blasters and ClubCat HP made by
Technological Artisans. Their laser projectors may contain
argon/krypton, DPSS frequency doubled Nd: YAG or 400- 700
nanometer solid state diode laser systems.
The firm also may manufacture, report, and certify Class IIIb iv laser light show proj ectors under this variance. 'Further, firm may incorporate into their laser light shows any laser
projection systems, which have been certified and reported firm or by another manufacturer under an approved laser light
    show variance, except:
    ,
    1) projection systems designed or intended to produce
visible effects by means of invisible, laser
    emissions, or
    2) projection systems designed or intended to produce
    audience scanning effects.
The firm's laser light shows may be presented at permanent
pr temporary locations in any type facility or outdoor,
unenclosed area for any contracted locations.
The effects employed may be front and rear screen
    projections, multiple reflections/ diffraction effects.
reflections from stationary from stationary mirrors, and
    enhanced scattering effects..

That's right... duh. Mine has similar wording and that basically covers it. I just don't have the "ClubCat and PartyBlaster" line and, can manufacture and certify to class 4.

Yeah, ADDING a projector to a variance is not a big deal and in fact most variances do not require that a specific projector be added on paper as long as it is a) certified compliant by the manufacturer and b) will not be used in a manner other than approved on the variance and c) is consistent with the terms of the variance (eg. if your variance is for 300mW you can't use a 1W without requesting a revision).

The issue here seemed to be whether the laser could be transferred before the user HAD a variance. Perhaps I misread, i did skim it quickly.

I guess I'll buy one of these things and take it apart.
I'll report back if it's compliant or not. If not I'll do the modifications required to make it compliant so I don't have a paper weight.
On that note, how do you guys feel about the CNI diodes? 3mm at <1.0mrad sounds pretty good to me.

    LOLOLOL i know.. the 2.5w is 3600 and has a 3mm 1mrad 637.

BUT the flashlight can be cool for the dark red overhead beam shows and closer distances

the dramatic impact you get from going from a 650 red to a 445 blue or 532 green is awesome.

EDIT: Im a beam show junkie

My turn to notice a couple things in the pictures that could be problematic. Not difficult to remedy but, problematic. I can't see evidence of an emission indicator on the front and it looks like thumbscrews on the back to gain access to the heads. You'd likely need to put in an indicator and swap the thumbscrews for some type of fastener requiring a tool. Even a screwdriver is fine but, a tool nonetheless. At least, in the spirit of the thread, to be compliant. Even for a home brew box.

    Just an observation.

Agreed with the thumbscrews allowing access without a tool, but emissions indicator is not required.. it is recommended
